In lieu of an abstract, here is a brief excerpt of the content:Liberalism, Art, and FundingDale Francis MurrayLiberalism, Art, and FundingSince Ronald Dworkin published A Matter of Principle, a host of critics have attempted to systematically dismantle his arguments advocating state support for the arts that appear in a chapter entitled, "Can a Liberal State Support Art?"1 The combined critical force of Noël Carroll, Samuel Black, and most recently, Harry Brighouse, has dislodged the main supports of Dworkin's position on (...) this subject.2 However, while I am skeptical that the arguments of liberals who endorse state support for the arts can be fully resurrected, I reckon that a few remarks can be presented to try to deflect at least a fraction of the contentions cast on Dworkin's argument by the critics listed above. In order to refine our understanding of precisely why state support for cultural expression should or should not be permitted, it is imperative that some sort of response to the critics of state support for the arts is offered.In this essay, I focus primarily on Brighouse's objections that Dworkin's arguments supporting arts funding fail primarily because they are not sensitive enough to the ways in which such support violates two demands of justice in a liberal state — state neutrality and publicity. I examine these two objections since they seem to be the most interesting, compelling, and damaging to Dworkin's case if substantiated. If Brighouse is correct, these violations act as heavy bulwarks against state support for arts funding, especially since public distrust of the state's intent (and the state's perceived advocacy of notions of the good with which the public disagrees) is high. I will employ Brighouse's neutrality of intent constraint, because it best represents the alleged specific violations of state neutrality that may undermine Dworkin's case. Additionally, neutrality of intent is the most plausible form of neutrality for advocates of public arts funding to build a case for in the space of a short essay.I also wish to make a distinction, which for the most part, is ignored by Dworkin's critics — that there is a degree to which moral value and aesthetic value are different and that this effects a possible alternative reading of the term "ways of life" as most liberals understand it. As a final note of preface, I will assume that the background conditions of income and wealth are just.3 This proviso will become important when we examine the role of the market in funding arts projects in lieu of the government. Now let us reiterate the two requirements of any just liberal state that are at issue when considering the legitimacy of state support for the arts. [End Page 116]Brighouse sets the pair of constraints on any just liberal state (neutrality and publicity) as the centerpieces of his essay. Neutrality of intent, that he appeals to more specifically, can be understood to mean, as Brighouse himself explains, "[T]hat while it is unobjectionable that state actions will have differential effects on conceptions of the good, the government should not intend to favor some conceptions over others" (NPS, 38, emphasis mine). The publicity constraint can be characterized by saying that in any just, liberal regime, justice must not only be done, but it must also be seen as being done. While this serves as the motto of the publicity constraint, it is significant to acknowledge that it stipulates that the real reasons for governmental action must be comprehensible to, and available for inspection by, reasonable citizens. In addition, it must be readily apparent to citizens that the demands of justice are being met. I will return to this constraint on the state later in this essay.Neutrality is of chief interest, since recent liberal political philosophers have emphasized the primacy of the right over the good (RLD, 245). Presumably, individuals, via their rational autonomy, shall define the good for themselves beyond the dictates of government. In this essay, we argue that the acceptance of gifts by health professionals from the pharmaceutical industry is morally problematic. We conclude that whether physicians view the receipt of items from drug detailers as entitlements or gifts, this practice is unacceptable, as it constitutes a conflict of interest. In addition, we argue that these gifts are particularly problematic in academic hospitals. Physicians-in-training are inculcated with the belief that receiving gifts is morally acceptable. While I may seem to be critical of Jecker’s (2008) article, most of this commentary is quite friendly excepting that 1) she needs to sharpen her focus on a couple of issues as Iexplain below, and that 2) she exaggerates the paucity of attention paid to her topics. That said, I believe that on Jecker’s view there is a need for a broader view of policy in healthcare.

DNA gyrase, an enzyme unique to prokaryotes, has been implicated in almost all processes that involve DNA. Although efficient inhibitors of this protein have been known for more than 20 years, none of them have enjoyed prolonged pharmaceutical success. It is only recently that the mechanisms of inhibition for some of these classes of drugs have been established unequivocally by X‐ray crystallography. It is hoped that this detailed structural information will assist the design of novel, effective inhibitors of DNA gyrase.

Whatever the finer details, Francis Hutcheson is clearly some form of proto-, quasi-, pseudo-utilitarian. But for any utilitarian, the full picture of their moral theory will only emerge once we understand their theory of the good. What, according to said utilitarian, is the nature of happiness? How do we aggregate happiness across persons? In this paper, I discuss two important aspects of Hutcheson's utilitarian axiology each with their own puzzles of interpretation. The first involves Hutcheson's theory of happiness or (...) the ‘natural good’. Hutcheson appears to vacillate between a quantitative hedonism and a qualitative hedonism. The second concerns Hutcheson's aggregative axiology. Hutcheson appears to offer three inconsistent approaches to understanding the overall good. Bringing these puzzles to light, I think, brings forward a number of challenges in understanding the normative ethics of a key figure in the development of utilitarian moral thought. (shrink)

Francis Hutcheson’s theory of value is often characterized as a precursor to the qualitative hedonism of John Stuart Mill. The interpretation of Mill as a qualitative hedonist has come under fire recently; some have argued that he is, in fact, a hedonist of no variety at all.1 Others have argued that his hedonism is as non-qualitative as Bentham’s.2 The purpose of this essay is not to critically engage the various interpretations of Mill’s value theory. Rather, I hope to show (...) that Hutcheson should not be read as a qualitative hedonist. The evidence for Hutcheson as a qualitative hedonist is strong and striking. In this nicely written book, Dale Murray critically discusses the moral rights posited by Robert Nozick in Anarchy, State, and Utopia. His focus is on these rights and not on Nozick's arguments about the justness of the state. He argues that Nozick's rights to compensation give rise to rights to government-financed health care and that Nozick should recognize a natural right to enough goods to ensure a reasonable chance of living a decent and meaningful life (if feasible for (...) all). Murray also discusses issues such as the role of invisible hand arguments, moralized conceptions of freedom, and the issue of whether just steps (transactions) preserve the justice of situations. For much of the Wrst half of the twentieth century Gilbert Murray was a leading Wgure (...) in British academia, in British theatre, on the British and American lecture circuits and even in British politics. He was admired by the community of scholars as Regius Professor of Greek at Oxford, the most prestigious position in classical scholarship in the English-speaking world. He was also esteemed by a wider reading public as the champion of a magisterial liberalism rooted in classical Greek culture. Finally he was respected by the world at large as a liberal activist who, during World War 1, wrote well-argued pamphlets in support of the war and who later became co-chairman of the League of Nations Union, an organization that in the ’20s and ’30s attracted 400,000 members. Among his companions were George Bernard Shaw and Bertrand Russell, both of whom remained his friends for life. As chief editor of the Home University Library he commissioned Russell’s The Problems of Philosophyz, which is still unsurpassed as an introduction to this subject. Today he is forgotten. Younger classical scholars would endorse the statement by Fowler (quoted in this volume): “in spite of his great fame when he was alive, he might never have written, so far as most scholars are concerned today” (p. 58). His role as the public intellectual who connected modern liberalism with Hellenism has been taken over by the followers of Leo Strauss who view this connection rather diTerently than Murray did. As for his liberal activism, when he died in 1957 Murray was regarded aTectionately as a noble ghost of Victorian liberalism past, whose passionate advocacy of the League of Nations was seen as well meaning and futile as the organization he had championed. In the ’60s and ’70s his words and deeds were swept away in the tides of anti-liberal fervour that inspired the newly emerging leftist revolutionaries and neo-conservatives. At Wrst perusal Gilbert Murray Reassessed zhas the format of festschrifts and other scholarly reviews of the accomplishments of a particular writer. But this volume is more than a summing up of Murray’s contributions to scholarship. The aim of the volume is to revive Murray the public intellectual, a voice of liberalism that deserves a new hearing. The book could have been entitled Gilbert Murray Retrieved for Our Timesz: a contribution to the struggle to Wnd a liberalism that addresses the anti-liberal, anti-intellectual forces that threaten us today. In this spirit the volume is dedicated to those who died in the London terrorist attack of July 2005. The volume opens with two sets of memoirs, one by Murray’s grandchildren Ann Pauladan and Alexander Murray, the other Francis West’s account of Murray ’s reXections on an Australian childhood. The memoirs of his grandchildren, aTectionate and charming, seem less interested in refashioning Gilbert Murray for our time. They still portray Murray as one who inhabited a world that is no more, the proponent of a liberalism that was naively optimistic and top heavy with reason at the expense of the emotions. Murray’s optimism is evident in their anecdote about an encounter between Murray and Sir Edward Grey, during a summer walk in 1914. Murray opened the conversation by scoUng at rumours of impending war in Europe, for him impossible between civilized powers.
